ARTICLE1: Object

 These "terms of use" are the legal framework conditions for provision of site services and their use by evernew.fr "User".

 The terms and conditions must be accepted by any user wishing to access the site. They constitute the contract between the site and the user. Access to the site by the User indicates acceptance of these terms and conditions.

 In case of non-acceptance of the terms and conditions stipulated in this contract, the User must give up access services offered by the site.

 Evernew reserves the right to unilaterally modify at any time the content of these terms and conditions.

 This cluse has define the various essential terms of the contract:

 "User": This term means any person who uses the Site or any service offered by the site.

 "User Content": These are the data transmitted by the user within the site.

 "Member": The User becomes a member when identified on the site.

 Username and password: This is all the information needed to identify a user on the site. The username and password allow the user access to services for members of the site. The password is confidential.

All costs incurred by the user to access the service (hardware, software, Internet connection, etc..) are in charge of the user.  The trademarks, logos, signs and other site content is subject to protection by the Code of intellectual property and especially by copyright.

The user shall obtain prior permission from the website for any reproduction, publication, copying contents.  The user agrees that the use of the contents of the site in a strictly private. Use the content for commercial purposes is strictly forbidden. A content posted by the user is his sole responsibility. The user undertakes not to put online content may adversely affect the interests of others. Any legal proceedings initiated by a third party against the injured site will be borne by the User. The content of the User may at any time and for any reason deleted or modified by the site. The user receives no justification and notification prior to the removal or alteration of the User Content.

 The sources of information available on the site are deemed reliable. However, the website reserves the right to non-guaranteed reliable sources.  The duration of this contract is unlimited. The contract is effective with respect to the User from using the service.

 ARTICLE 11: Applicable law and jurisdiction

 French law applies to this contract. If no amicable settlement of a dispute arise between the parties, the courts of the jurisdiction of the Court of Appeal Toulon are competent.
