These general conditions of sale apply to all sales made by our Compagny Evernew, subject to the special conditions set out in the presentation of products.

ARTICLE 2: Essential characteristics of products and services sold
The Internet evernew.fr site offers manufacturing prosthetic orthodontics as well as services.
The customer declares to have read and accepted the terms and conditions prior to placing an order. The validation of your order implies acceptance of terms and conditions of sale.
ARTICLE 3: Price
The prices of our products are indicated in € or $ taxes included.
For orders delivered to a country other than France, the customer is the importer of the products they buy. For all products shipped outside of overseas or EU authorities, the invoice is the price excluding VAT. The customer is solely responsible for reporting and payment of any customs duty or other tax may be payable in the country. Shipping fees are included in the price of products for France and European countries.
ARTICLE 4: Time product availability
The services are performed within 2 to 3 weeks. Shorter time may be granted on request. These deadlines are indicative considering manufacturing constraints and no compensation can be claimed in case of failure to meet deadlines.
ARTICLE 5: Command
To order, you must attach an order stating clearly your details and specific requirements.
If you want, you will receive an e-mail of confirmation of your order on the address you provided when creating your account address.
ARTICLE 6: Delivery
We proceed to the delivery of your order in France including Corsica and DOM-TOM and Europe. Delivery takes place at the address specified by the buyer.
We ship followed by Colissimo or letter followed by the size of the shipment. We can also ship items by specialized carrier with surcharge.
Delivery times vary from 2 to 5 days hours depending of the country.
ARTICLE 8: Payment
You can pay your order by check, bank transfer, credit card or American Express card.
ARTICLE 10: Warranty
Each client has its own requirements. We are committed to produce a product or a personalized service. You can return the products to us for a modification of the work if necessary in a delay of one month. In case of failure, it is usually necessary to return the product at our expense (we can deduct the charge from a bill).
ARTICLE 11: Conditions and repayment
In case of non satisfaction you have the right not to pay your bill. You have only to inform us within one month after receipt.
ARTICLE 12: Complaints
All claims should be sent by phone or email.
ARTICLE 13: Intellectual Property
All comments, images, illustrations of our site are expressly reserved to us. Under the intellectual property and copyright, any use is prohibited except for private use.
Unauthorised reproduction of this website, whether total or partial, is strictly prohibited.
ARTICLE 14: Responsibility
Pursuant to Article 1147 of the french Civil Code, we pledge our contractual strict liability to you for any breach or improper performance of the contract.
However, our contractual liability shall be incurred in the situations mentioned below :
- in case of force majeure.
- in case of loss of goods by carriers during transport to our company or back to the client.

The Evernew compagny is subject to professional secrecy with regard to medical practitioners and their patients.
No personal data arecollected on the site. Personal data provided to Evernew are strictly confidential. They are not sold nor shared with third parties without the written permission of the practitioner.
ARTICLE 16: Jurisdiction and Applicable Law
In case of dispute between the client and our consumer society, only the French law is applicable. The French courts have unique expertise to resolve the dispute.Toulon courts shall be exclusive jurisdiction in any dispute.
